NGO moves PIL in HC against daily shutdowns in Valley

Mirwiaz aide attacks hardliner for daily strikes

Srinagar, Oct 18: A Non Government Organization—Rahul Gandhi Foundation, Monday moved a Public Interest Litigation in High Court against continued strike by separatists in Kashmir.

Sources said that the NGO through its top office bearer, Ghulam Qadir moved the PIL before the registry of the court, calling for end to the daily shutdowns by the seperatists.

“The PIL has been moved to Chief Justice for its approval,” sources in state High Court said.

They said the litigant has made hardliner Syed Ali Shah Geelani and his close confident and underground wanted separatist Masrat Alam Bhat as respondents while calling for an end to daily strikes. The petitioner has maintained that strikes were having a telling effect on common masses in Kashmir particularly public sector entrepreneurs and students. Kashmir valley is in the middle of unrest that has already completed 128 days. During the course, over one hundred people have died and nearly six hundreds were injured.

This is the second writ of its kind during the unrest. Earlier in September this year, National Panthers Party chief Bhim Singh had filed a petition in the Supreme Court against the continued curfew in the Kashmir Valley.

Meanwhile, senior leader in moderate faction of separatist faction and chief patron of Islamic political Party, Mohammad Yousuf Naqash openly attacked hardliner Syed Ali Shah Geelani for continued shutdowns.

In a statement here, Naqash said that people in Valley have been left to starve. “Neither empty stomach raise the voice of freedom nor can illiterate people prove fruitful for the movement,” he said. “The freedom movement may take decades and for sustaining and promoting this ongoing momentum of the movement, economic and educational activities are a necessity. Otherwise, there is every apprehension of the failure of this movement,” he said, adding, “It is the responsibility of those devising the calendars (referring to Geelani) to devise protest chart keeping in view restoring economic activities “at least to the extent of fulfilling basic necessities of life and an uninterrupted education.”

LeT Com’der among 3 killed in Kashmir

Srinagar, Oct 18: Three persons including a top commander of Lashker-e-Toiba, a soldier and civilian were killed in separate gunfights in Kupwara and Baramulla districts of north Kashmir, officials said Monday.

They said a division commander of LeT was killed in a gunfight with 3-Madras unit of army in Barzulla forests in Bandnipora district last night.

Lt Col JS Brar, Defence ministry spokesman based here, said that the encounter started Sunday evening after the army unit launched an operation following specific information about the presence of militants in the woods. The militants, he said, present in the area opened fire which was retaliated, triggering off a fierce gunfight. “One foreign militant was killed during the course of operation,” he said.

The army officer said that the slain is believed to be divisional commander of LeT, Abu Dawood, a wanted militant who carries bounty of Rs 11 lakhs on his head. An Ak-47 and ammunition has been recovered from the encounter site, he added.

In another operation, the defence ministry officer said that army’s 4 JAT foiled an infiltration attempt by militants along Line of Control (LoC) in Uri sector of Baramulla district last night.

He said that group of heavily armed militants tried to sneak through Golta Nallah near Uri sector during the intervening night of 17 and 18 October. However, alert troops spotted the group and asked them to surrender. “The militants turned down the offer and instead opened indiscriminate fire, resulting into the death of a jawan, Kartar Singh,” he said.

The militants, Brar said, managed to retrieve towards Pakistan Occupied Kashmir, taking advantage of the darkness.

Meanwhile, a sexagenarian civilian was killed in “cross firing” between militants and troops of 19 Rashtriya Rifles in Handwara area in the frontier Kupwara district on wee hours today.

JS Brar, the army spokesman, said that the civilian— Muhammad Mukhtar Shiekh, was killed in cross firing near Bawan Watsar area in the forests. The slain civilian was grazing cattle when the incident occurred, locals said.

The gunfight between militants and troops was going on when reports last came in, army spokesman said.

No Dussehra celebrations in Kashmir

SRINAGAR, October 16:

The topsy-turvy situation in Kashmir valley has
again led to the cancellation of Dussehra celebrations, symbolizing
victory of good over evil, in Kashmir valley and this time round, the
reason stands—unrest.
Kashmiri Pandit Sangharsh Samiti, an organisation representing
Kashmiri Pandits in the valley, has rescinded its programme of burning
the effigy of demon king Ravana to mark one of the biggest festivals
of Hindu religion.
It was after a gap of 20 years in 2007 that Pandits burnt the effigies
of Ravana on the eve of Dussehra in Srinagar with a fanfare and the
tradition was repeated in 2009 but it remained a low key affair.
“The main aim to revive the age old tradition and religious function
was to give all the pandits putting up in the valley a reason to meet
at a single place besides marking our presence here. But the
contemporary situation we are in today is not feasible enough for the
function,” Sanjay Tickoo, president of Kashmir Pandit Sangharash
Samiti told this news paper.
“Today alone, only few members of the community could participate in
the Puja at Hariparbat temple on the eve of Navratra compared to a
relatively large number last year,” he said, adding, "the members of
the community living in villages prefer to stay in their respective
towns in view of the unpredictable and volatile present-day
situation.”
Tickoo said that KPSS had planned a big function this year and
intended to burn all the three effigies of Ravana, Kumkaran and
Megnath.
“The preparation had to be done in advance for the function as
material and artists for effigies are to be brought from Delhi. In
2007, when we burnt effigy of Ravana only but this year we had planned
that we will burn all the three effigies. But due to the situation, we
have decided to cancel the function,”he said.
According to the government figures more than 250,000 Pandits fled
Kashmir since the outbreak of militancy in the state in 1989, one of
the biggest migrations of any community from the state.
The decision of KPSS not to hold the function has disappointed many
Muslims in the valley.
“I don't think the situation is too explosive for any community to bar
its religious activities,” said Bashir Ahmad, a local.
He said last year it was Muslims who stood besides the Pandits when
effigy of Ravana was burnt to ashes at sher-i- Kashmir stadium in
Sonwar to mark the occasion of Dussehra.
"It was delightful for everyone here when the revival of the festival
was made after so many years. It has been age old tradition of people
to celebrate Dussehra, Eid or any other festival together. Pandits are
part and parcel of this culture," he asserted.
Meanwhile, Mahavawmi was celebrated with religious ferver in Kashmir.
“Special Puja was done and wish was made to lord to normalize the
situation in Kashmir,” Manhat Madhav Das of Hanuman Mandir said.

Kashmir see normal day, 5 held for stone-pelting

Srinagar, Oct 16: Kashmir Valley on Monday witnessed a rare normal day
as there was no strike by separatists nor did authorities clamped
curfew restrictions anywhere across the state.
The markets in Srinagar and other major towns were abuzz with activity
as shopkeepers opened their outlets ahead of their usual schedule on
Saturday morning.
While government offices remained closed on account of a public
holiday—Mahanawmi—, private offices and other commercial
establishments opened as per their normal schedule, officials said.
Lal Chowk, this summer capital’s commercial hub, was choked with
bumper-to-bumper traffic.
Many private schools were also open — despite it being a holiday — to
conduct exam for various classes excluding those conducted by State
Board of School education.
The state administration did not impose curfew anywhere while the
separatist Hurriyat Conference led by hardliner Syed Ali Shah Geelani
had kept the day outside the purview of its already announced
strike-protest calendar.
A police spokesman said the situation across the Kashmir Valley
remained peaceful as no untoward incident occurred anywhere.
“The situation remained normal and under control throughout the
Valley,” the spokesman said.
Meanwhile, in fresh raids, police arrested five youth on charges of
stone-pelting from Baramulla and Habba Kadal locality in civil lines
here.
Three youths—Abdul Hameed Hajam, Hilal Ahmad Rather and Showkat Ahmad
Mir were arrested from Pattan Baramulla, a police official said.
However, he refused to identify the youths arrested from Habba Kadal.

Mujhe tum yaad kartay ho???
Tumhain main yaad ati hoon?
Meri batain satati hain??
Meri nindain jagati hain??

Kisi Khamosh rastay say koi awaz ati hain??
Sard raton main tm ab bhi chat pay jatay ho?
Falak kay sabz sitaron ko meri batain sunatay ho?
Kitaboon say tumhary ishq main koi kami ayi?
Ajab pagal si larki hai...
Mujhe har khat main likhti hai,
Jawaban us ko likhta hon,
Meri masrofiyat dekho subha say shaam office main,
Charagh-e-umar jalta hai,
Phir us k baad duniya ki kai majborian paon main bairi dal rakhti hain,
Mujhe bayfikar chahat say bharay sapnay nahi dikhtay,
Tehalnay jagnay ronay ki muhlat hi nahi milti,
Sitaron say milay arsa hua naraz hon shayad,
Kitaboon say shagaf mera abhi waisay hi qaim hai,
Farq itna para hai ab unhain arsay main parhta hoon,
Tumhain kis nay kaha pagli tumhain main yaad karta hon..
Kay main khud ko bhulanay ki musalsal justajo main ho,
Tumhain na yaad anay ki musalsal justajo main ho,
Magar yeh justajo meri buhat nakam rehti hai,
Meray din raat main ab bhi tumhari sham rehti hai,
Meray lafzoon ki har mala tumharay naam rehti hai,
Tumhain kis nay kaha pagli tumhain main yaad karta hon
Purani baat hai jo log aksar gungunatay hain,
Unhain hum yaad kartay hain jinhain hum bhool jatay hain,
Ajab pagal si larki hai.
Meri masrofiyat dekho,
Tumhain dil say bhulaon to tumhari yaad aye na,
Tumhain dil say bhulanay ki mujhe fursat nahi milti,
Aur is masrof jewan main tumhary khat ka aik jumla
Tumhain main yaad ati hon?
Meri chahat ki shiddat main kami honay nahi daita,
Bht retain jagata hai mujhe sonay nahi daita,
Agli baar khat main yeh jumla nahi likhna,
Ajab pagal si larki hai..
