HC reserve verdict on Bar Prez’s lodgment

Lawyers extend strike till 19 July

While as the state High Court reserved the judgment on plea demanding shifting of advocate Mian Abdul Qayoom—president Kashmir High Court Bar Association—from Jammu jail to Srinagar, the lawyers Thursday extended the ongoing strike till July 19.

After a marathon debate by counsel for petitioner, advocate Zaffar Ahmad Shah and state Advocate General Mohammad Ishaq Qadri, justice Hakeem Imitiyaz Hussein reserved the verdict on the petition seeking shifting of advocate Mian Abdul Qayoom from sub-jail in Hiranagar Jammu to Kashmir. The court also directed state to file detailed account about the capacity and the number of detainees/prisoners in jails in Kashmir valley.

Earlier as soon as the hearing of the case started, advocate Zaffar Ahmad Shah, argued vigorous while holding that the bar president’s detention was illegal and unconstitutional. He also said that as per the law, Mian Qayoom is formally a resident of Srinagar and can’t be detained outside his ordinary residence.

On July 07, the state administration booked under Public Safety Act Advocate Qayoom and shifted him to sub-jail Hiranagar in Jammu. The case pertaining to the quashing of PSA against bar president is listed in the court for Tuesday.

Meanwhile, Bar Association has decided to continue with its strike till July 19.

“We have decided to continue with the strike till Tuesday,” acting president of KHBA, Advocate Aijaz Baider told reporters

He said that the decision to this effect was taken an executive council meeting presided over by him as the vice-president of the association. The meeting followed the general body meeting of the KHBA, he added.
